car seats booster age

At what age can a child legally be in a car without a booster seat?
In the state of NY
I JUST looked this up for the kid I babysit. All children age 6 and under must be restrained in a safety seat or booster seat. Children 40 pounds and below must be in a child safety seat and all children above 40 pounds must be restrained in a booster seat using an adult lap and shoulder belt.
Here is the Board of Health website for you to read:
http://www.health.state.ny.us/prevention/injury_prevention/booster_seat.htm
Check out the .pdf brochure for height, weight, and seat belt fit guidelines, especially if your child is over the age of 6. Booster seats are recommended for kids through age 8, so even though your child may not be required by law to be in a seat, he or she may still need one.
