Can My Husband Be Arrested for Kidnapping or Other Charge?
My husband has a 10 mo old with another woman. She refuses to allow my husband to take their son out of Her home, and introduce the son to me (wife) and our two children so we can form a bond with this baby. The circumstances are difficult, because my husband and the mother of the infant 10 mo old had an affair and the baby resulted from their relationship. They are no longer carrying on the affair, but my husband wants his baby to meet his & my entire family. He viists the baby regularlly and pays child support. The mother wants no part of allowing me to know and bond with this infant. She Hates me and Totally disrespects me! My question is….If my husband while visiting this baby decides, without the mother knowing, to just take the infant and put him in a car seat to our marital home to introduce him to me and our kids, can my husband get in trouble with the law? What if she calls the police and says he kidnapped the baby? What are my husband’s rights?
First of all, talk to a lawyer. If your husband is paying child support, he needs to go after visitation and/or joint custody…something of that nature. He should be able to get at least visitation. When he does, the mother will not be able to tell him where he can and can’t take the child. Then, he can bring the child to your home without any legal problem.
Although I do not know if it would be considered kidnapping, it sure could lead to a big mess.
For now, abide by the mother’s rules. Seek the help of a lawyer who can go about this the right way.
